Congresswoman Claudia Tenney has reintroduced the Protecting Gun Owners in Bankruptcy Act, aiming to safeguard Second Amendment rights for all Americans irrespective of their financial circumstances. The legislation, which includes support from Representatives Mike Collins, Burgess Owens, and Randy Weber, proposes that up to $3,000 worth of firearms be exempt from bankruptcy proceedings.
Under current federal law, certain property values are exempt from bankruptcy to help debtors maintain a basic standard of living. These exemptions include items like musical instruments and jewelry but do not specifically cover firearms. The proposed bill seeks to address this gap by recognizing firearms as essential property.
Congresswoman Tenney emphasized the importance of protecting the right to self-defense during financial hardship: “The Second Amendment is a Constitutional right for all Americans, regardless of their financial situation. No American should ever be forced to forfeit their right to self-defense because they’re going through financial hardship. This legislation ensures that the Constitutional right to own a firearm is protected, no matter the financial situation.”
